Terms and Conditions: For All Promotional Vouchers Purchased Through Active Endeavors Enterprise, Inc.

The following terms and conditions apply to all promotional vouchers ("Vouchers") purchased through Active Endeavors Enterprises, Inc. ("www.ActiveEndeavors.com"), except as otherwise specified on any particular Voucher and except as otherwise required by law. In the event of a conflict between these terms and conditions and the actual Voucher, the Voucher itself will control. All persons purchasing, printing, accepting, using or attempting to use any Voucher (each, a "Customer") agree to these terms and conditions.

All Vouchers are promotional in nature and are issued by the participating merchant or vendor ("Vendor") through www.ActiveEndeavors.com as a service provider. The Vendor is the holder and issuer of the Voucher and under no circumstances shall www.ActiveEndeavors.com be deemed the holder, issuer or seller of the Voucher. The law applicable to the Voucher shall be the law of the state where the Vendor interaction with the Customer occurs. As the holder and issuer of the Voucher, Vendor is solely responsible for the value and redemption of Voucher and for any and all damages, claims, liabilities and costs suffered by or relating to any Customer and the compliance with all laws, including, without limitation, unclaimed property and escheatment laws relating to the Vouchers. Each Customer hereby knowingly waives and releases www.ActiveEndeavors.com and its affiliates and their respective officers, directors, employees, shareholders, agents and representatives, from any and all injuries, liabilities, damages, claims and rights of any nature whatsoever arising from any act or omission of the Vendor in connection with the Voucher, the provision of the services and products relating to the Voucher, and compliance by the Vendor with applicable law, including, without limitation, unclaimed property and escheatment laws. ActiveEndeavors’s sole role is as a service provider for the Vendor, and the applicability and compliance with any relevant law relating to any Voucher is solely determined by and complied by the Vendor.

The Vouchers are coupons that provide a discount price from the actual or retail cost from the Vendor. That discount is available until the expiration date “Expiration Date” stated on the face of the Voucher “Face Value”. After that time, where and to the extent required by law or allowed by the Vendor, the Voucher may be redeemed by the Vendor for goods or services of the Vendor in the amount originally purchase amount paid for the Voucher “Cash Value” by the Customer to www.ActiveEndeavors.com and as otherwise set forth on the Voucher. For example, a Voucher purchased for a particular product or service offering of the Vendor at the discounted price of $50 (actual retail price of $100 “Face Value”) with an expiration date on the discount of 21 days from a specified date, may be used for to purchase the particular product from the Vendor for 21 days from such specified date. Customer's acceptance of any redemption of a Voucher constitutes an acceptance of the redemption and a waiver of any claims associated with the Voucher. The Voucher may not be redeemed for products or services other than those specified on the Voucher or as otherwise specifically permitted by this paragraph and may not be used to pay account balances or for products or services purchased from the Vendor prior to the purchase of the Voucher.

1. Terms and Conditions for Vouchers

* Unless otherwise specified by Vendor, Vouchers may be applied only to merchandise sold by Vendor on its web site, and may not be applied to shipping or handling charges.
* Limit one (1) Voucher per redemption. Only one Voucher can be used per order unless otherwise specified by Vendor.
* Each Voucher can only be redeemed through one transaction. After the Voucher has been redeemed on one transaction, the entire “Face Value” of the Voucher will expire.
* The issuing of credit is at the sole discretion of the Merchant unless otherwise required by law or unless otherwise specified by Vendor in “The Fine Print”.
* Neither www.ActiveEndeavors.com nor the Vendor is responsible for lost or stolen Vouchers or Voucher's reference number.
* Voucher cannot be combined with any other vouchers, third party certificates, coupons, or promotions, unless otherwise specified by Vendor.
* Reproduction, sale or trade of this Voucher is prohibited unless done so in compliance with applicable law or unless otherwise specified by Vendor.
* Any attempted redemption not consistent with these terms and conditions will render the Voucher null and void.
* Void to the extent prohibited by law.

2. Additional Terms and Conditions Applicable to Vouchers

All Vouchers shall be subject to the terms and conditions of www.ActiveEndeavors.com and the participating Vendor. The Vendor is the seller of the goods or services which you are purchasing.

If you redeem a Voucher for less than its Face Value prior to the Expiration Date, the Vendor will not be obligated to issue credit or cash for further redemption, either for the Face Value or Cash Value of the remainder of the Voucher.

Furthermore, certain Vouchers may cease to be redeemable even for their Cash Value after a certain date (the "Termination Date") beyond the Expiration Date. Please review the terms of the Voucher carefully to determine if the Voucher has a Termination Date. According to applicable law, the Vendor may be responsible for allowing you to redeem your Voucher for the Cash Value for a period of time that extends beyond the Termination Date on the Voucher. In other words, you should be allowed to redeem the Cash Value of your Voucher up until the greater of: (1) the Voucher's Termination Date; or (2) the minimum length of time allowed by applicable law for a Voucher to expire. Please contact the Vendor directly for all questions regarding the redemption of Vouchers.

YOU HEREBY WAIVE, EXCLUPATE AND RELEASE ACTIVE ENDEAVORS ENTERPRISES INC. AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS FROM, ANY CLAIM, LIABILITIES, DAMAGES, OR INJURY ARISING FROM OR RELATED TO (A) ANY ACT OR OMISSION OF MERCHANT IN CONNECTION WITH A VOUCHER, (B) THE SERVICES/GOODS PROVIDED IN CONNECTION WITH ANY VOUCHER, (C) ANY CLAIM FOR UNCLAIMED PROPERTY RELATING TO THE REDEMPTION OF ANY VOUCHER OR ANY PORTION THEREOF, (D) ANY VIOLATION BY MERCHANT OF ANY LAW, RULE, REGULATION OR ORDER, OR (E) ANY BEACH OR ALLEGED BREACH BY MERCHANT OF THE TERMS AND CONDITIONS OF ANY VOUCHER.
